O presente artigo é um estudo de escolástica barroca colonial que combina elementos lógicos, raciocínios práticos e probabilismo, para compreender o movimento processual das deliberações jurídico-políticas sobre “guerra e paz” no pensamento de Juan de Solorzano Pereira. Pensador escolástico do período barroco ibero-americano que residiu por mais de duas décadas nas Índias ocidentais, que elaborou e sistematizou o Direito Indiano, De Indiarum iure. Corpo sistemático e erudito no qual se encontram compiladas cédulas reais, leis, disposições ou mandatos régios; os quais (...) eram destinados a guiar os assuntos próprios de governo nas Índias ocidentais, fundamentados na guerra justa e na paz republicana. Na Filosofia do Direito Indiano de Solórzano Pereira, a opinião provável sobre fatos e direitos não se restringe aos atos perfeitos e os absolutos que se acreditam ter em opiniões mais prováveis do passado e do presente, porque a probabilidade nessa filosofia do direito está aberta ao futuro condicional, onde novas opiniões podem produzir dúvidas nos fatos e no direito, podendo se tornar em opiniões mais coerentes, seguras e mais prováveis que as anteriores, pela aceitabilidade racional sobre o direito em questão. Erros abrem brechas e podem ser motivos suficientes para modificar direitos por usucapião, retenção, prescrição, restituição. (shrink)

The Giving Voice to Values pedagogy and curriculum is described as an example of a powerful leverage point in the integration of business ethics and values-driven leadership across the business curriculum. GVV is post-decision-making in that it identifies an ethical course of action and asks practitioners to identify who are the parties involved and what’s at stake for them; what are the main arguments to be countered; and what levers that can be used to influence those who are in disagreement. The internalization of GVV’s constructs allows faculty to comfortably raise and endorse ethics as part of the natural order of business decision-making because the stakes of doing so have been normalized. Methods for introducing and using GVV in undergraduate through MBA courses are given. An illustration is given for economics courses. (shrink)

Este trabajo realiza un estudio metafísico sobre la noción de contacto en términos de límites a partir de una ontología de objetos materiales. Dos cosas están en contacto cuando sus límites (o partes de ellos) se topan espacialmente. Las tesis relacionista y la substantivista sobre la naturaleza del espacio son evaluadas en sus compromisos respecto a la idea de contacto. Sin embargo, puesto que considerando algunos descubrimientos de la física cuántica es posible descartar la idea de contacto físico, la discusión (...) requiere ser trasladada a un espacio topológicamente continuo. Aquí la idea de contacto requiere solucionar la compatibilidad entre la existencia de un espacio continuo y la existencia de límites como un tipo de discontinuidad. Cuatro tesis son evaluadas: clásica, superposición, brecha, y coincidencia. Esta última es defendida puesto que, a diferencia de las otras, no renuncia a características ontológicas fundamentales de un límite y es la menos arbitraria sobre su pertenencia. (shrink)

In this study, we propose considering membership in the Ethics Officer Association (EOA) as a proxy for the firm's commitment to ethical decision making, and we analyze the influence of firm- and CEO-specific characteristics on this commitment. While we observe a positive relationship between membership and firm size, we also document a negative relationship between EOA membership and the executive's time in position and, to a more modest extent, accounting returns. Pursuing this further, we present evidence that firms with past (...) legal issues may seek EOA membership as a signal of their intention to be compliant in the future. (shrink)

Todo el curso gravita sobre la función reproductiva de la trompa. La trompa, en fin de cuentas, es un oviducto. Ya bastante habrán dicho de todo ello Michel Idoate y Fernando de la Fuente. Yo lo que quiero hacer en mi charla es llamar la atención sobre los aspectos éticos de unos pocos hechos básicos: que, de ordinario, la fecundación tiene lugar en la ampolla tubárica y que aquí y en el istmo transcurren las primeras horas y los primeros días (...) del desarrollo embrionario. Estos hechos, tan conocidos, tienen implicaciones ético-médicas muy importantes. La principal de ellas, se refiere a quien sea el embrión humano que se engendra en la trompa y en ella habita cuatro o cinco días. Thwarted every possibility of an economy diversificied development and doonet the isle to a story where the slavery supergroning production with all its social and political implications prevailed. This system, that implied a crisis in itself, was absolutely artificial: it was a creator of richness for a very small group, and of course, it was unable to correct the tremendous condetions thas implied. Quantitative study of the effects of war in the Cuban population. Analysis of the demographic variables used as source of the "Report on the Census of Cuba of 1899", lifted by the American government. It includes graphics about the number and evolution of the births, inarriages and deaths in Cuba by provinces, and the natural grohth in the Island. It is demonstrated a demographic disaster associated to war, with the death of 200.000 souls approximately.

The hypothesis that this paper seeks to propose is that, despite all the difficulties for its conceptualization, Bataille postulates that the community is, after all, possible. To do this, we will seek to study the place of the community in Bataille's thought, a place that is not precisely identifiable at all, but rather is scattered throughout his work at different points. Thus, we will try, in the first instance, to analyze how a lost community appears in the French philosopher, in (...) order to, in a second place, investigate what was the - misguided - fascist response to that fact, and, finally, outline how it could erect a proactive model of community according to Bataille. This paper gives prescriptions for introducing ethical concerns into the economic theory of the firm. Topics include social responsibility, corporate governance, profit maximization, competition barriers, collusion, the market system, and welfare economics. The need for such prescriptions is based on a content analysis of 21 managerial economics texts for their coverage of ethics. My analysis finds that substantive discussions of ethics are conspicuous by their absence. As ethical breaches can involve significant monetary damages to a firm - particularly through adverse (...) market reactions - moral-reasoning abilities can complement analytical skills. Consequently, my analysis demonstrates how ethics figure into the opportunity costs of managerial decision making, which is central to the economic definition of profit. (shrink)

En el presente trabajo se pretende llevar a cabo una aproximación al fenómeno del colapso ecológico y su relación con la filosofía de la historia a través de las aportaciones de Walter Benjamin y Theodor Adorno. En este sentido, el fenómeno del colapso ecológico será abordado como la barbarie de nuestro tiempo, introduciéndonos en uno de los conceptos con mayor recorrido en la teoría crítica, para acto seguido explorar diversas vías filosóficas abiertas para hacerle frente en la actualidad.

El presente artículo tiene como objetivo principal presentar los principales resul- tados de una experiencia de innovación docente implementada en el 4º curso del Programa de Doble Grado en Derecho y Ciencias Políticas y de la Administración de la Universitat de València (UV). En concreto, se propuso, por parte del docente, una serie de fichas en las que se diseñaran medidas para acabar con la corrupción. Esta actividad tuvo lugar durante los meses de abril y mayo de 2022. This study examines the deliberations of professional MBA students when presented with a dilemma that weighs the difference between commitments to profit-maximization against concerns for fired workers who would need to seek a new job during a recession. Using content analysis, accounting, economic, and ethically based rationales that differ from the profit-maximizing recommendation are categorized. Results also show that those who make non-profit-maximizing recommendations consider, but ultimately reject the profit-maximizing approach to layoffs.

The fact that boundaries are ontologically dependent entities is agreed by Franz Brentano and Roderick Chisholm. This article studies both authors as a single metaphysical account about boundaries. The Brentano-Chisholm theory understands that boundaries and the objects to which they belong hold a mutual relationship of ontological dependence: the existence of a boundary depends upon a continuum of higher spatial dimensionality, but also is a conditio sine qua non for the existence of a continuum. Although the view that ordinary material (...) objects and their boundaries (or surfaces) ontologically depend on each other is correct, it does not grasp their asymmetric relationship: while the existence of a surface rigidly depends upon the existence of the very object it belongs to, the existence of a physical object generically depends upon having some surface. In modal terms, both are two kinds of de re ontological dependence that this article tries to distinguish. (shrink)

BackgroundThe COVID-19 pandemic has hit almost all countries around the globe, seriously affecting the welfare of populations. Spain is especially hard-hit. In this context, the purpose of the present study is to analyze social, demographic, and economic correlates of mental health during the COVID-19 pandemic in the population residing in Spain.MethodThe sample of this cross-sectional study was comprised of 801 participants aged 18 or older and residing in Spain. Data collection was carried out during March and April 2020. Data of (...) mental health and well-being indicators, and those of a wide number of social, demographic, and economic variables were recorded. Linear regression models were built to value associations between mental health and social, demographic, and economic indicators.ResultsMental health morbidity was higher in women, younger people, individuals with medium studies, people with fewer children, singles, students, and unemployed individuals. Positive affect was higher among women, people with a high level of studies, those not co-living with dependent seniors, the self-employed, the employed, and those working outside home. Negative affect was negatively associated with age and number of children and was higher among women, people with basic studies, singles, individuals co-living with dependent seniors, homemakers, and students.ConclusionThe most vulnerable populations were found to be women, younger people, people with basic or medium studies, students and individuals with no remunerated activities, single populations, and those co-living with dependent seniors as well as those with a reduced number of children. The river Portoviejo crosses four cantons of the province of Manabí and is the main source of water for the inhabitants of the area to be used in various uses. The objective of this bibliographic review article is to carry out a historical analysis of the water pollution of the Portoviejo River. The qualitative and descriptive documentary research methodology was used. The authors conclude that the factors that influence the pollution of the Portoviejo River are the constant direct discharges of (...) wastewater and solid waste along its route by the residents of the area and the contribution of the water treatment plant waste from the area. The aim of this paper is to introduce a new approach to the modal operators of necessity and possibility. This approach is based on the existence of two negations in certain lattices that we call bi-Heyting algebras. Modal operators are obtained by iterating certain combinations of these negations and going to the limit. Examples of these operators are given by means of graphs.

El presente trabajo se ocupa del lugar de la religión en la última etapa de la obra de Habermas. En la primera parte se muestran las diferentes aristas de la cuestión de la religión, poniendo énfasis en los aspectos filosófico-políticos, sobre todo el que concierne a la “traducción” del lenguaje religioso al secular como un “requisito” de acceso a la esfera pública. En la segunda parte, se reconstruye, señalando sus límites o dificultades, el concepto de “traducción” en Habermas. Para ello, (...) se apela, además, a algunas categorías conceptuales propuestas por Jean-Marc Ferry. La traducción en este marco puede ser entendida en dos sentidos: como una reformulación semántica que apunta a ampliar el universo discursivo de origen (traducción como desencapsulamiento) y como una transformación de los géneros pre o para-argumentativos en argumentativos (traducción como cambio de género discursivo). This article analyzes the evolution of Philosophy of Educationin Spain and its situation at the dawn of the 21st century. Spain'speculiar socio-historical circumstances have largely conditioned thedirection this discipline has taken over the last several decades. So,although during a period there was some approximation towards themethods of analytic philosophy, Philosophy of Education has never fullyrelinquished its normative vocation. To do so would have meant spurningthe hopes and fears that had filled Spanish society by the mid 1970supon the reinstatement of civil (...) liberties and democracy. Indeed,attention to the circumstances and that normative orientation have foundtheir best fit in a practical Aristotelian-based philosophy meant toendow Philosophy of Education with a normative character that do notshun the educator's need for reflection, practical decision-making, andresponsibility. Since the 1990s, new directions have been marked by thechallenge of postmodernism, inasmuch as it affects not only thetechnological positivist model but also the reflective educator's modelof a practical Philosophy of Education. The new directions spread out invarious ways, yet they all fall into a common denominator of narrativetrends. The problem posed by these new languages lies in the extent towhich they are consistent with pedagogic intent. In turn, the answerstake on different profiles depending on whether the stance leans moretowards the philosophical or the pedagogical point of view withinPhilosophy of Education. The complementary nature of both perspectivescharacterizes the current state of the field in Spain. (shrink)

This article has two parts. The first one compares the ontological and epistemological implications of two main philosophical stances on how reality relates to appearance. I call the first group the “plane of superficiality,” where reality and appearance are the same; there is no gap between what a thing is and how it manifests itself. I call the second group “volume of representation,” in which reality is beyond appearances; there is an insurmountable gap between the thing and its phenomena. The (...) second part of the article focuses on Graham Harman’s Object-Oriented Ontology (OOO) as the second group’s contemporary position. Within the OOO epistemological model of “knowledge without truth,” Harman’s schema of the observer’s participation in the object’s knowledge production is questioned. Alternatively, based on the notion proposed here of “flat representativity” in which each appearance is equally valuable to represent different aspects of the object, I argue for the full spectrum of the sensual as the basis for “knowledge without truth.” In particular, the aesthetic method, excluded from Harman’s concerns about knowledge, is suggested as another contribution to the episteme. In order to develop efficient tools for automated reasoning with inconsistency (theorem provers), eventually making Logics of Formal inconsistency (_LFI_) a more appealing formalism for reasoning under uncertainty, it is important to develop the proof theory of the first-order versions of such _LFI_s. Here, we intend to make a first step in this direction. On the other hand, the logic _Ciore_ was developed to provide new logical systems in the study of inconsistent databases from the point of view of _LFI_s. (...) An interesting fact about _Ciore_ is that it has a _strong_ consistency operator, that is, a consistency operator which (forward/backward) propagates inconsistency. Also, it turns out to be an algebraizable logic (in the sense of Blok and Pigozzi) that can be characterized by means of a 3-valued logical matrix. Recently, a first-order version of _Ciore_, namely _QCiore_, was defined preserving the spirit of _Ciore_, that is, without introducing unexpected relationships between the quantifiers. Besides, some important model-theoretic results were obtained for this logic. In this paper we study some proof–theoretic aspects of both _Ciore_ and _QCiore_ respectively. In first place, we introduce a two-sided sequent system for _Ciore_. Later, we prove that this system enjoys the cut-elimination property and apply it to derive some interesting properties. Later, we extend the above-mentioned system to first-order languages and prove completeness and cut-elimination property using the well-known Shütte’s technique. (shrink)
